Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Seven16 Email (“Service”), operated by Seven16 Group (“we,” “us,” or “our”). By creating an account or sending email through the Service, you agree to these Terms.

1. Service description

Seven16 Email is an email marketing and automation platform built for insurance distribution, wholesale and MGA operations, DOT/trucking outreach, and agency recruiting. The Service provides contact management, campaign building, sequence automation, deliverability infrastructure, and reporting.

2. Eligibility and account

You must be at least 18 years old and authorized to bind the entity on whose behalf you use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Acceptable use

You agree NOT to use the Service to send messages that:

  • Lack a clear opt-in or other lawful basis under CAN-SPAM, CASL, GDPR, CCPA, or other applicable law in the recipient's jurisdiction.
  • Are sent to recipients from purchased, harvested, scraped, or rented lists.
  • Impersonate another person, entity, or domain (including spoofed From: or Reply-To: addresses).
  • Promote illegal goods or services, deceptive financial offers, adult content, malware, phishing, or content that violates intellectual property rights.
  • Originate from a domain you do not own or have not authenticated with us.

We monitor sending reputation, bounce rates, complaint rates, and suppression-list growth. We may throttle, suspend, or terminate accounts whose sending patterns indicate noncompliance. CAN-SPAM compliance — including a clear sender identity, a physical mailing address in every marketing message, and honoring unsubscribe requests within 10 business days — is your responsibility as the sender.

4. Your content and data

You retain all rights to the contact data, templates, and content you upload (“Customer Content”). You grant us a limited license to process Customer Content solely to operate the Service on your behalf (sending messages, deliverability monitoring, reporting, etc.).

You represent that you have a lawful basis to process every contact record you upload, that contacts have opted in to receive your communications (or you have another lawful basis to email them), and that you will honor unsubscribe and access requests promptly.

5. Subscription and billing

Paid plans are billed monthly or annually in advance via our payment processor. Annual plans are non-refundable after 14 days. You may cancel at any time; cancellation takes effect at the end of your current billing period. Usage that exceeds your plan's included contacts or sends will incur overage charges at the rates posted on our pricing page.

Trial accounts are limited to 100 contacts and 500 sends over a 14-day period. We may revoke trial access if we detect abuse, list quality issues, or attempts to circumvent trial limits.

6. Suspension and termination

We may suspend or terminate your account immediately, without prior notice, if we believe in good faith that:

  • You have violated these Terms or our Acceptable Use rules.
  • Your sending threatens the deliverability reputation of our shared infrastructure.
  • Your account is delinquent for more than 14 days after notice of nonpayment.
  • We are required to do so by law or by our upstream providers (Resend, Supabase, Vercel, etc.).

Upon termination, you may export your data for 30 days via the Service, after which we may delete it.

7. Service availability and changes

We aim for high availability but do not guarantee uptime or uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. We will not materially reduce features mid-term for paid plans without offering a pro-rated refund.

8. Disclaimer of warranties

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant inbox placement, open rates, conversion rates, or revenue outcomes.

9. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or loss of business opportunity.

10. Indemnification

You agree to indemnify and hold us harmless from any claim brought by a third party arising out of (a) your Customer Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your breach of any representation in Section 4.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Travis County, Texas.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app banner at least 30 days before they take effect for paid customers. Continued use of the Service after the effective date constitutes acceptance.
